LEGAL RESOURCES

Due to the expertise of the legal professionals associated with the BAA in business and contract law and real estate law, we are able to provide partner-level experience to entry level and seasoned entrepreneurs and business owners.  The BAA recognizes that entrepreneurs and business owners often lack certain basic understanding of how business/contract law and real property/real estate law affects their business.  Therefore, the BAA desires to get “back to the basics” to teach entrepreneurs and business owners why a solid legal foundation is essential for business growth and sustainability.

Real Property and Real Estate Law

The BAA’s goal is to align entrepreneurs and business owners with professionals who are skilled in defending and protecting their property rights.  Real property and real estate laws is are integrated in the places we live, work and play, so it is important to understand how these bodies of law govern who owns and uses the land.  In addition to federal laws, each state has laws that are unique to that state so it is imperative to be associated with professionals who are staying abreast of the ever changing business and regulatory environment in this area.

RISK MANAGEMENT RESOURCES

Risk Management planning is common in larger organizations, but the BAA recognizes that entrepreneurs and business owners could benefit from these services if scaled to meet their needs.
It is important for businesses of any size to have documented plans to maintain business continuity in the case of a disruption to normal operations.  Risk management is critical because it  allows for faster recovery of critical business operations, minimizes loss, complies with legal and regulatory requirements and avoids damage to the reputation of your business.

The BAA can assist you in preparation of certain Risk Management documents including:
  • Business Continuity Plan (“BCP”) Assessment
  • BCP Preparation
  • BCP Testing Plan

CONTRACT COMPLIANCE RESOURCES

Many business owners and entrepreneurs often do not understand the important role that contract compliance plays in the operational efficiency and risk reduction of a business.  Likewise, they tend to believe that issues related to contract compliance are only applicable to the “big businesses” with lots of large contracts.  This is a myth, which can be costly for business owners.  Potential clients and owners may question the small business’ ability to successfully perform their contractual obligations.  Instances of non-compliance may, among other things, lead to contract termination, non-renewal, or the loss of future contracting opportunities.

The BAA will provide guidance on contract compliance management to potentially mitigate risks and establish a checklist of key contract terms and provisions.

The BAA can assist you in developing contract compliance tools to:
  • Establish a process for creating and negotiating contracts.
  • Develop standard contract templates and monitoring compliance, such as a contract compliance matrix, alternate contract clauses, and explanations of relevant legal concepts.
  • Review and approve any variations from standard provisions, terms or policies and procedures.
  • Implement controls to minimize non-compliance issues.
  • Manage, monitor, and audit contracts.
